Privacy Policy

Introduction

Welcome! You have arrived at Benefact4 (the “Application”), an application owned and operated by Benefact4, LLC, a Massachusetts limited liability company (“Benefact4” “Company” or “we,” “our” or “us”).  This Application allows you to track your donations and participation in other activities such as mentoring, walking, running, or participating in other activities ) on behalf of certain charities

We respect your privacy and value the trust you place in us. Therefore, we have instituted this privacy policy (“Privacy Policy”) to describe: (i) the types of information we collect; (ii) how we use it; and (iii) how we safeguard it. We encourage you to read this entire Privacy Policy. We also encourage you to review the Application’s Terms of Service (the “Terms”), which governs your use of the Application. By creating a Benefact4 account or by using any Benefact4 service, whether through a mobile device, mobile application or computer (collectively, the “Service”) you agree to be bound by the Terms and this Privacy Policy (collectively the “Agreement”) Any undefined capitalized terms in this Privacy Policy are being used in accordance with their definitions in the Terms.

1. What Information Do We Collect? 

A) Information You Provide To Us

Personal Information and Demographic Information.  When you create an account in the Application, you provide us with certain categories of information such as (1) personal information, which is information that could reasonably be used to identify you personally, such as your name, e-mail address, phone number and Device Identifier (defined below) (“Personal Information”); and (2) demographic information, such as residential address and geographic location (“Demographic Information”). Whenever we associate Demographic Information with your Personal Information, we will treat it as Personal Information.

B) Information We Collect As You Access And Use The Application and/or the Services

In addition to any Personal Information or other information that you choose to submit to us, we and our third-party service providers may use a variety of technologies that automatically (or passively) collect certain information whenever you interact with the Application and/or the Service (“Usage Information”).  

This Usage Information may include the type of phone that you are using, the areas within the Application and/or Service that you visit, the time of day you use the Application and/or the Service, the number of activities you complete using the Application and/or the Service, the charities for which you participate using the Service, and the types of activities you record using the Service, donations you make, and your location (“Location Data“).  

We may use Usage Information for a variety of purposes, including, amongst other things, to (1) enable you to use the Service to track activities in support of charity, and (2) enhance or otherwise improve the Service. With regards to Location Data, we may use such data to enable you to record the activities you perform, distance you traveled and other activities you participated in, when using the Service.  We do not currently use, but may use in the future, Location Data in connection with any advertising served from ad networks.  We do not currently serve, but may serve in the future, advertising from ad networks in the Service.  We do not currently store, but may store in the future, your Location Data.

In addition, we may collect your IP address or other unique identifier (“Device Identifier”) for your phone or other device used to access the Service (any, “Device”).  A Device Identifier is a number that is automatically assigned to your Device used to access the Application, and our computers identify your Device by its Device Identifier.  Usage Information may be non-identifying or may be associated with you.  Whenever we associate Usage Information or a Device Identifier with your Personal Information, we will treat it as Personal Information.  

A few of the methods that may be used to collect Usage Information include the following:

  • Cookies.  A cookie is a data file placed on a Device when it is used to visit the Application and/or the Service. A Flash cookie is a data file placed on a Device via the Adobe Flash plug-in that may be built-in to or downloaded by you to your Device. Cookies and Flash Cookies may be used for many purposes, including, remembering you and your preferences and tracking your visits to our web pages. For more information about cookies visit https://www.allaboutcookies.org. If you choose to disable cookies or Flash cookies on your Device, some features of the Service may not function properly. 
  • Web Beacons.  Small graphic images or other web programming codes called web beacons (also known as “1×1 GIFs” or “clear GIFs”) may be included in our web pages and messages.  Web beacons may be invisible to you, but any electronic image or other web programming code inserted into a web page or e-mail can act as a web beacon.  Web beacons or similar technologies may be used for several purposes, including, to count visitors to the Application, to monitor how users navigate the Service, to count how many e-mails that were sent were opened, or to count how many particular links were viewed.  
  • Embedded Scripts.  An embedded script is programming code that is designed to collect information about your interactions with the Service, such as the links you click on. The code is temporarily downloaded onto your Device from our web server or a third-party service provider is active only while you are connected to the Service, and is deactivated or deleted thereafter.

C) Information Third Parties Provide About You 

We may, from time to time, supplement the information we collect about you online with outside records from third parties to enhance our ability to serve you, tailor our content to you, and offer you opportunities to purchase products or services that we believe may be of interest to you. We may combine the information we receive from those sources with information we collect through the Service. In those cases, we will apply this Privacy Policy to any Personal Information received, unless we have disclosed otherwise. 

D) Information You Provide About A Third Party 

If you send someone else an electronic communication from the Service, such as sending an invitation to a friend to join the Service, the information you provide (names, e-mail addresses, etc.) is used to facilitate the communication and is not used for any other marketing purpose unless we obtain consent from that person or we explicitly say otherwise. Please be aware that when you use any send-to-a-friend functionality in the Service, your name and e-mail address may be included in the communication sent to your friend.

2. Who Owns Information Once It Is Submitted

We own any information collected in our database.  However, we will use this information only in the ways described in this Privacy Policy.  

3. How Do We Use The Information Collected?

A) Use of Information by Us.

We may use your Personal Information, Demographic Information or Usage Information that we collect about you: (1) to provide you with information or services or process transactions that you have requested or agreed to receive; (2) to enable you to participate in the Application and/or Service’s features; (3) to process your registration with the Service, including verifying your information; (4) to improve the Service, to customize your experience on the Service, or to serve you specific content that is most relevant to you; (5) to email you newsletters featuring stories about Benefact4, our charity partners, our members and our sponsors; (6) to bring you select retail or other marketing opportunities via email, SMS messages, direct mail and telemarketing; (7) to contact you with regard to your use of the Service and, in our discretion, changes to the Service’s policies; (8) for internal business purposes; and (9) for purposes disclosed at the time you provide your information or as otherwise set forth in this Privacy Policy. 

Please note that information submitted to the Service via a “contact us” or other similar function may not receive a response.  

 

4. How and When Do We Disclose Information To Third Parties?

A) Generally

When you use the Service to donate, walk, run, mentor or engage in any other activity on behalf of a charity, we will not sell, rent or otherwise share any of your Personal Information to any third party without your express consent

We may share non-personally identifiable information, such as Demographic Information, Usage Information, and aggregated user statistics, with third parties. To the extent we share any such information with third parties, those third parties shall treat it by their respective privacy policies.

B) Other Members

You share information when you voluntarily disclose information on the Application and/or the Service (including your public profile). Please be careful with your information and make sure that the content you share is stuff that you’re comfortable being visible. If you choose to limit the audience for all or part of your profile or for certain content or information about you, then it will be visible and shared according to your settings.

C) Third Parties Providing Services On Our Behalf

We may use third-party vendors to perform certain services on behalf of the Application and/or the Service, such as hosting the Application, designing and/or operating the Application’s features, and tracking analytics.  We may provide these vendors with access to user information, including Personal Information, to carry out the services they are performing for you or us.  While we may use third-party analytics service providers to evaluate and provide us with information about the use of the Application and viewing of our content, we do not share Personal Information with these analytics service providers, but they may set and access their cookies, web beacons, and embedded scripts on your Device and they may otherwise collect or have access to information about you, including non-personally identifiable information. 

D) Administrative and Legal Reasons

We may access, use, preserve, transfer, and disclose your information (including Personal Information), including disclosure to third parties: (i) to satisfy any applicable law, regulation, subpoena, governmental request, or legal process if in our good faith opinion such is required or permitted by law; (ii) to protect and/or defend the Service’s Terms or other policies applicable to the Service, including investigation of potential violations thereof; (iii) to protect the safety, rights, property or security of the Service or any third party; and/or (iv) to detect, prevent or otherwise address fraud, security or technical issues.  Further, we may use IP addresses or other Device Identifiers, to identify users, and may do so in cooperation with third parties such as copyright owners, internet service providers, wireless service providers, and/or law enforcement agencies, including disclosing such information to third parties, all in our discretion.  Such disclosures may be carried out without notice to you. 

E) Business Transfer

We may share your information, including your Personal Information, Demographic Information, and Usage Information with our subsidiaries and affiliates for internal reasons. We also reserve the right to disclose and transfer all such information: (i) to a subsequent owner, co-owner, or operator of the Service or applicable database; or (ii) in connection with a corporate merger, consolidation, restructuring, the sale of substantially all of our membership interests and/or assets or other corporate change, including, during any due diligence process.    

5. What About the Information You Disclose Publicly?

A) User Generated Content and Public Information

This Privacy Policy does not apply to any information that you elect to share or disclose publicly or otherwise share using the Service. We are not responsible for the accuracy, use, or misuse of any content or information that you share or choose to disclose publicly through the Service. 

6. Do Third Party Content And Links To Third Party Sites Appear in the Application?

The Application and/or Service may contain content that is supplied by a third party (such as a charity or sponsor), and those third parties may collect website usage information and your Device Identifier when web pages from the Application are served to your browser. In addition, when you are using the Service, you may be directed to other sites that are operated and controlled by third parties that we do not control. We are not responsible for the privacy practices employed by any of these third-party sites. For example, if you “click” on a charity’s banner or advertisement within a profile, the “click” may take you off the Service onto a different website.  These other websites may appear in “baby browsers” within the Application and may send their cookies to you, independently collect data or solicit Personal Information, and may or may not have their own published privacy policies. We encourage you to note when you leave our Service and to read the privacy statements of all third-party websites before submitting any Personal Information to those sites.

7. Are There Third-Party Ads Served On The Application?

Although we may feature content from charities and sponsors in the Service, we do not currently use network advertisers to serve advertisements (such as banner advertisements or other advertisements) in the Service. However, in the future, we may use third-party network advertisers to serve you advertisements in the Service. We may also use third-party analytics service providers to evaluate and provide us with information about the use of the Application and viewing of our content.  

8. How Do You Change Your Information And Communication Preferences?

You are responsible for maintaining the accuracy of the information you submit to us, such as your contact information provided as part of registration. You can make any necessary changes to this information through your profile page in the Application.  Further, if you wish to access, correct, update or request deletion of your Personal Information, you can do so at any time by contacting us by email at info@benefact4.com.

We respond to verifiable requests received from individuals who wish to exercise their data protection rights in accordance with applicable data protection laws. When contacting us, please provide us with detailed information about the personal information you are requesting we correct, update, amend, or remove, and the timeframe and manner in which you believe we came to collect your personal information.

9. How Long Do We Keep Your Information?

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy policy, based on the following criteria: 

  • For as long as we have reasonable business needs, such as managing our relationship with you and managing our operations 
  • For as long as we provide services to you 
  • Retention periods in line with legal and regulatory requirements or guidance 

10. What About Consent To Transfer Information To The United States?

The Application and/or the Service operate in the United States.  If you are located anywhere outside of the United States, please be aware that any information we collect, including but not limited to, Personal Information, will be transferred to, processed, and stored in the United States. The data protection laws in the United States may differ from those of the country in which you are located, and your Personal Information may be subject to access requests from governments, courts, or law enforcement in the United States according to laws of the United States.  By using the Application and/or the Service or providing us with any information, you consent to this transfer, processing, and storage of your information in the United States. 

11. What Should Parents Know About Children?

The Application and/or the Service is a general audience application and we do not knowingly collect any Personal Information from children younger than the age of thirteen (13). We will delete any Personal Information collected that we later determine to be from a user younger than the age of thirteen (13). If you are a parent or guardian of a child under the age of thirteen (13) and believe he or she has disclosed Personal Information to us, please contact us at legal@benefact4.com

12. What About Security?

We incorporate commercially reasonable safeguards to help protect and secure your Personal Information.  We maintain physical, electronic, and managerial practices and procedures designed to ensure the security, integrity, and confidentiality of customer information.  We limit and restrict access to Personal Information only to those employees who need it to carry out their business functions.  We will monitor and adopt, as appropriate, new technological improvements that are designed to aid in ensuring the accuracy and security of customer information. 

However, no transmission or electronic storage of information can be guaranteed to be 100% secure.  Please note that we cannot ensure the security of any information you transmit to us, and you use our Application and/or the Service and provide us with your information at your own risk.  

13. What About Changes To The Privacy Policy?

We reserve the right to change this Privacy Policy at any time without notice to you.  Any changes will be effective immediately upon the posting of the revised Privacy Policy. However, we will not use your Personal Information in a manner materially different than what was stated at the time it was collected without your consent.  

14. How Do You Delete Your Account and Data?

If you want to delete your account and data, please to the setting sections in the Service and select the appropriate setting to delete your Account.  After you delete your account or if your account is terminated for any other reason,  you will have ninety (90) days to restore your account.  If your account is not restored within ninety (90) days, we will delete all data associated with it, except to the extent we are required to retain it under applicable law.  .

15. European Economic Area, United Kingdom, and Switzerland Residents.

If you are a resident of the European Economic Area, United Kingdom, or Switzerland, to the extent that the foregoing provisions do not already provide this certainty, your data protection rights are as follows: 

  • If you wish to access, correct, update or request deletion of your Personal Information, you can do so at any time by contacting us by email at legal@benefact4.com.   
  • You can object to processing of your personal information or ask us to restrict processing of your Personal Information. 
  • You can exercise these rights by contacting us by email; provided, however, that restricting the processing of your Personal Information will likely impede your ability to use the Application and/or the Service. 
  • You have the right to opt-out of marketing communications we send to you at any time. You can exercise this right by clicking on the “unsubscribe” or “opt-out” link in the marketing e-mails we send you. 
  • If we have collected and currently process your Personal Information with your consent, then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect the processing of your Personal Information conducted in reliance on lawful processing grounds other than consent. 
  • You have the right to complain to a data protection authority about our collection and use of your Personal Information. 

We respond to verifiable requests received from individuals who wish to exercise their data protection rights in accordance with applicable data protection laws. When contacting us, please provide us with detailed information about the personal information you are requesting we correct, update, amend, or remove, and the timeframe and manner in which you believe we came to collect your personal information. 

16.  California Residents.

A) Generally

  • The California Consumer Protection Act (CCPA) provides consumers (California residents) with specific rights regarding the processing of their Personal Information. the CCPA is more protective of consumers’ privacy than the laws of other jurisdictions, or as otherwise may have been reflected herein, we adhere to the standards set forth in the CCPA with respect to all of our Users. 

To the extent that the foregoing has not already provided certainty on such matters, the following shall clarify the rights of California residents. 

In the preceding 12 months, we have collected the following categories of personal information about our Users. We may collect this Personal Information directly from you, from third parties, and from your interactions with our Application and website. For additional details regarding the Personal Information we collect, please review Section 1 above. As defined by CCPA, the personal information categories are: 

  1. Identifiers: username, residential address, phone number, email address and Device Identifier. 
  2. Characteristics of protected classifications under California or federal law: None.
  3. Geolocation data, as described in Section 1 above. 
  4. Audio, electronic, visual, thermal, olfactory, or similar information: such as photos that you upload to the Application and/or the Service as User Generated Content. 
  5. Professional, Social or employment-related information: to the extent you are on a company team or some other group we record that you are on that company’s  or group’s team.

With regard to Personal Information provided by you, from third parties, or from your interactions with our Application and/or Service, we may retain Personal Information for as long as is needed for the purpose(s) for which it was collected and no longer than is relevant and reasonably necessary. Our retention periods vary based on business, legal and regulatory needs. 

  1. We may collect the categories of personal information described above for business and operational purposes, marketing and commercial purposes, security purposes, and legal and compliance purposes, as further described above in Section 3 above. 
  2. In the preceding 12 months and where applicable, we have disclosed each of these categories to our service providers  in line with the applicable purpose(s) as described above in Section 4. 
  3. In the preceding 12 months, we have not disclosed any the above categories of personal information to third-party advertising partners. 
  4. In the preceding 12 months, we have not collected, shared, or sold any sensitive personal information as described in the CCPA.  
  5. Your rights: 
  6. a) You have the right to know what personal information we collect, use, disclose, share and sell about you.

    b) You have the right to request we correct personal information we need, collect and maintain about you if such personal information is inaccurate.

    You have the right to request we delete personal information we collect and maintain about you.

    c)You have the right to opt-out of the sale or sharing of your personal data. We share personal data only as described above, which may be considered a “sale” of personal data under the CCPA. 

    d) You have the right to limit the use or disclosure of your sensitive personal data. We do not collect, share, or sell sensitive personal data.

    e)You have the right not to receive discriminatory treatment from us for exercising your privacy rights under the CCPA.

    f)You have the right to designate an Authorized Agent to make a request on your behalf when exercising your privacy rights under the CCPA.

  7. How to contact us about your rights: 

We respond to verifiable requests received from individuals who wish to exercise their data protection rights in accordance with applicable data protection laws. If you would like to exercise your privacy rights under CCPA, please email your request to legal@benefact4.com and provide us with your first name, last name, and email address. If you do not provide the requested information, we may not be able to identify you and process your request. The information you provide will be used only to help verify and process your request. 

If you are an authorized agent making a request on behalf of a California consumer, please email your request to legal@benefact4.com and provide us the first name, last name, and email address of the California consumer you are making the request for. If you do not provide the requested information, we may not be able to identify the California consumer and process the request. The information you provide will be used only to help verify and process the request. We reserve the right to request you demonstrate evidence of your authorization, either by providing us with a signed permission form or a copy of your power-of-attorney document granting you such authority.
